Phoenix Solar Pty Ltd respects and is committed to protecting your privacy and treats all personal information provided in accordance with the National Privacy Principles for the fair handling of personal information pursuant to the Privacy Act 1988 as amended. As part of our normal operations we collect, use and from time to time disclose information about you to third parties. This statement details the steps we take to protect your personal information. It describes the personal information we collect, how we will collect it and how we will use it. Also described are the security precautions we take to protect your personal information and how you can access this information and update it if necessary. 1. COLLECTION

1.1 Overview

Phoenix Solar only collects information that is necessary to undertake core functions and activities and to enable us to best meet your needs. Such information is collected using fair and lawful means and not in any unreasonable or intrusive manner.

1.2 Sensitive information

Other than in the rare and exceptional cases outlined in the National Privacy Principles, we will not collect sensitive information about you without your prior consent.

1.3 Our Websites


1.3.1 Collection of personal data
In general, you can visit the websites of Phoenix Solar without entering any personal information. On certain pages, we may ask for personal information to enable us to provide a service or carry out a transaction that you request. You do not need to provide any of this information, but it may be that we are less able to support you without it. The personal information we request may include:

  • contact details such as name, title, name of your company / organisation, email address, telephone and fax numbers, and postal address;
  • information about your company and your position;
  • your preferences for e-mail marketing;
  • your country of residence to allow us to determine your closest agent and eligibility under export control regulations;
  • information that is used to customise your use of our site, including login and technical data, and enquiries about our products and services;

1.3.2 Collection of anonymous data
Anonymous information is collected when you visit our website. Your browser sends such information to every website you visit. This information is not linked to your identity, and is used solely for statistical purposes. It may include: your IP address, browser type and functionality, browser language, operating system details, date and time you accessed the site and the site from which you were directed to our site.

1.3.3 Cookies
On our site we usually use cookies; small pieces of text stored on your hard drive by a web browser. Only in exceptional cases are session cookies used to store data for the technical session control in your browser. This data is not personal and will be deleted when you close your browser. Should we need to save personal information in a cookie, we will obtain your consent. You can visit our website without cookies, however most browsers accept cookies automatically. You can prevent cookies from being saved by setting this in your browser settings. If you reject cookies, you may experience functional limitations when using our website.

2. USE AND DISCLOSURE

2.1 Overview

We use your personal information to provide certain services to you or to carry out transactions you have requested, such as providing information about Phoenix Solar products, registering purchased products, processing product orders, handling warranty claims, replacing product manuals, answering technical support requests, etc. To enhance your interactions with Phoenix Solar, it is possible that we will combine data collected on our website with information that we have acquired through other means.
We do not sell, rent or otherwise make available any personal data to persons or organisations outside the Phoenix Solar Group except as outlined in section 2.2.
In connection with a job application or inquiry, you may send us information about yourself. This information is used within the Phoenix Solar Group to evaluate your application and is stored for future reference unless you direct us otherwise.

2.2 Services and transactions

Information you provide to Phoenix Solar will not be passed on to companies outside the Phoenix Solar Group without your consent, with the exception of the following:

2.2.1 Service providers
We instruct other companies to provide services on our behalf, such as hosting and analysing our websites and providing professional services such as banking, accounting and legal advice. These companies receive only the information they need for the provision of the service. It is prohibited for those companies and their employees to use this information for any other purpose.

2.2.2 Distributors
In responding to a request received from you we may disclose your personal information or any part thereof to government agencies, shipping companies or postal authorities involved in the storage, shipment, importation and/or distribution of our products. In such cases, we provide these companies with only the information necessary to process your request. It is prohibited for those companies and their employees to use this information for any other purpose. In some cases, we may request your consent to disclose your information to distributors for marketing purposes. We may disclose your personal information for such marketing purposes only if you have given us your written consent.

2.2.3 Other third parties
We may disclose personal information if under law or in good faith, we believe that such action is necessary for compliance with legal obligations or arrangements, the protection of our rights and our property or in urgent circumstances to protect the personal safety of a person.

We may use the information you provide for secondary purposes directly related to our core interaction and to inform you of product and service offerings. We will always give you the opportunity to stop receiving such communications.

3. OUR WEBSITES

3.1 Links to other sites

Our websites may contain links to other sites, for example, to Phoenix Solar distributors and sales affiliates, professional associations, government agencies and publications. While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the content, security and privacy of these sites. We do not control whether the providers of such sites observe the applicable laws and accordingly, this Privacy Policy does not cover other websites. Please note the relevant provisions of other providers for data protection.

3.2 Minors

Our website is not intended to attract, nor do we knowingly collect personal information from, minors. Upon request, the legal representative (parent or guardian) of a minor may inspect the information provided and/or request that it be deleted.

4. DATA SECURITY

Phoenix Solar is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorised access, use or disclosure. Your personal data will be stored on computer systems with limited access that are located in institutions with strict access controls. You are responsible for ensuring the security of your login and password details and are encouraged not to share this information with third parties.

5. DATA QUALITY, ACCESS AND CORRECTION

Phoenix Solar endeavours at all times to ensure that the personal information collected, used and disclosed is accurate, complete and up-to-date. If you believe that any information we are holding about you is incorrect or incomplete, please write to or email us as soon as possible. We will promptly correct any information found to be incorrect. Details of the personal information that we hold about you may be accessed in accordance with the requirements of the National Privacy Principles. In general, you have a right to:

  • obtain without charge your information that we have stored
  • correct, block or request deletion of such information.

6. TRANSBORDER DATA FLOWS

As a global company, we have offices around the world. It may be that the information you provide is transferred to another country. Information you submit may be stored in hardcopy form or on servers outside of Australia. All Phoenix Solar operations and websites are subject to relevant Privacy Statements. We bind each employee to data protection and confidentiality.

7. CHANGES AND ENQUIRIES

7.1 Changes to this Privacy Statement

Phoenix Solar may update this Privacy Policy from time to time and you are therefore encouraged to visit the website on occasion to ensure that you are satisfied with any such changes. We will obtain your consent should a proposed upgrade materially expand the sharing or use of your personal information in a way that was not explained at the time of collection of the information in this Privacy Policy.
